Your rights as a driver or rider
What to do at a traffic stop, your rights when arrested, and getting paid for your work.

When a police officer stops you
- Stay calm and pull over safely.
- You can ask the officer to identify themselves.
- You have the right to be told, in a language you understand, why you are being stopped or arrested. (Article 49)
- You have the right to remain silent, and you must not be forced to confess to anything. (Article 49)
- If you are arrested, you must be taken to court within 24 hours. (Article 49)
Your vehicle and property
Your property, including your vehicle, may not be seized unlawfully. (Articles 31 and 40)
If you are charged
You are innocent until proven guilty, and you have the right to a fair hearing. (Article 50)
Moving and living
Every person has the right to move freely, and every citizen can live anywhere in Kenya. (Article 39)
If you work for a ride-hailing or delivery app
You have the right to fair labour practices — fair pay and reasonable working conditions — whether you are treated as an employee or as self-employed. (Article 41)
